Unfair Dismissal

Losing your job can be an incredibly traumatic and stressful situation as you will have found yourself instantly without an income. The situation is even worse if you have suffered an unfair dismissal. Unfair dismissals can arise in a number of situations such as:

  • Dismissal for poor performance which has not previously been addressed
  • The employer has following an unfair procedure
  • Incorrect or unfair selection for redundancy
  • Dismissals for reasons related to health and safety

What Can You Do?

If you consider that you have been unfairly dismissed, you may be entitled to claim compensation or, in some cases, even apply for an order for reinstatement.

In order to bring an unfair dismissal claim you must have been an employee with (subject to certain exceptions) at least 1 year’s continuous service at the date on which your employment was terminated if based in Northern Ireland or 2 years if you worked in England, Scotland or Wales.

A claim for unfair dismissal must be brought to the Employment Tribunal within 3 months of the date on which the employment ended.
