PAID TRAVEL TIME FOR CARE WORKERS
For many years, care staff have been employed by local authorities to visit sick and elderly clients in their own homes to check on their health and well-being and to assist them to continue living within the community. Despite doing such fantastic work, many local authorities have decided that such staff should be paid only for time actually spent in the client’s home and not time spent travelling between houses.
What this means is that, in many cases, care staff can spend up to 10 hours per week travelling to assist the most vulnerable people in our communities yet will not receive a penny for this time. Not only is this morally wrong but it has recently been found to be unlawful.
In the case of Whittlestone v BJP Home Support Ltd, a care worker brought a claim against her employer in which she argued these very points. The Employment Appeal Tribunal agreed with Mrs. Whittlestone deciding that all time travelling between homes on a rota should be paid.
